[...] So now we will have a YouTube.com (not utube.com) competitor named joost.com (pronounced juiced.com) and no doubt encountering the same traffic confusion that Universal Tube experienced but hasn’t handle well.
Well done observation. I was thinking much of the same today after reading TW. Even if there was an inkling of going in this direction, it seems like they could have created a really good building supply/pipe/whatever resource.

Aside from diluting their brand name... and I'm not a lawyer but...

If they put up an engine / search service like this, it may show that they are temporarily trying to make a buck off of the brand confusion. Which may make them loose in a lawsuit.

Although it may seem very similar on the surface, it seems like it would be more defensible to put up a tube/construction/whatever supply engine/resource as it could be argued that perhaps they were going to do that anyway, before the youtube confusion.

Perhaps simply to provide a resource to customers. But any judge/lawyer/seo/etc. that knows a small bit about the internet, can probably see, as you do, that this looks like an attempt to market based on the temporary URL confusion rather than something normal/expected as part of a site's marketing/evolution over time.
